Police were taking serious illegal measures in their investigation of Prime Minister Benjamin Netanyahu, which resulted in the dismissal of the charges, Netanyahu lawyers told the court.
Boaz Ben Tsur and Amit Hadad, the prime minister’s attorneys, submitted around 200 pages to the court on Sunday alleging that Netanyahu was marked by the legal system and that inappropriate and criminal actions were taken during the investigation, including investigation contamination and selective enforcement.
The document claims that Netanyahu’s investigation involved “unprecedented levels” of criminal activity.
“The way the investigation was carried out shows that the investigators realized early on that the prime minister had not committed a crime. So they did not investigate a crime, invented a crime and then committed criminal acts to prove it,” he said the lawyers charged.
“These criminal acts are not acceptable in any investigation, let alone a prime minister’s investigation, and therefore the charges should be dismissed,” they urged the court.
The allegations include allegations that police investigators lied to the court and received a search warrant intended to reveal details unrelated to the investigation in order to threaten a suspect who later signed a state witness agreement.
Additionally, the witnesses in the case faced unprecedented criminal lying pressure, including threats of harm to their family and children, denial of rights, harassment, denial of medical care, refusal to write their versions, and many other violations.
Any direction of investigation that was inconsistent with the allegations in the cases has been completely ignored, the lawyers said.
The Prime Minister’s investigation was “unprecedentedly polluted” by hundreds of leaks from police and prosecutors.
These leaks were not investigated or treated by the Attorney General, who refused.
They also said the interrogation records were skewed by investigators. The files contained dozens of examples of dramatic gaps between the transcripts of the interrogations and the summary of the interrogations conducted by investigators in order to achieve the desired results for them.
The lawyers also pointed to “selective enforcement” in the absence of any investigation into ministers and Knesset members who had received compassionate reporting, allegedly a form of bribery.
The lawyers said their request included “a long list of serious errors and deficiencies committed during the investigation process into the Prime Minister’s case”.
“These are totally inadequate investigative measures, endless leaks – hundreds of investigative materials in violation of the law and a public trial in the media before the trial begins,” they accused.
“In an orderly state, law enforcement agencies must comply with the principles of justice and fairness when conducting an investigation. In our opinion, the total accumulation of serious shortcomings should lead to the charges being dismissed, ”they concluded.
Netanyahu has been charged with bribery and breach of trust in three corruption cases.
Netanyahu has repeatedly denied any wrongdoing, calling the allegations a “hostile medium” witch hunt against him and his family and an attempt by left-wing officials to influence the outcome of the election.
