A Claimant, Chief Gaskin Sobrasuaipiri, dragged an attorney, Prince G Akitoye, to a Supreme Court in Port Harcourt on Wednesday seeking N100 million in damages for allegedly negligent exposure of a will prepared for him by the attorney.
In the subpoena served on the Defendant, the Claimant requests the presidency of Judge Okogbule Gbasan’s “Declaration that the Defendant’s (Akitoye’s) act of giving the Claimant s will to read before adding their signatories in the presence of the Claimant is unprofessional and is negligent and unlawful.
“A statement that it would be unprofessional for the defendant to allow his clerk, who is in the same location as the Claimant, to edit the will from the defendant’s office in order to deposit the will.
“An order from the court directing the defendant to return the file copy of the Claimant’s will in the defendant’s possession, since the will has been revoked.
“The sum of only one hundred million naira is general indemnity for the negligence of the defendant and the trauma / pain suffered by the Claimant as a result of the defendant’s unprofessional handling of the will.”
The Claimant in the Statement of Claim provided by his attorney, Erasmus Dike, further stated: “One of the witnesses argued with the Claimant because he gave him nothing in his will but gave a lot to others.
“The relationship between this witness and the Claimant has now turned sour because the defendant disclosed the contents of the will to the witness.”
